Their coercive negotiation tactics have been viewed as problematic not only by the companies subjected to negotiations, but also by other labor unions.

The newly clarified team roles and responsibilities are as follows:

Makoto Watanabe designed the entire project and hosts weekly regular meetings.

The private secretary's spouse conducts negotiations with companies and reports figures regarding the number of cases and amounts at regular meetings.

Satoshi Saito, a certified public accountant, verifies the reported figures.

Defendant Tamayoshi Nakano single-handedly takes charge of the labor union's name, presentation, promotional materials, and other branding.

Mr. Watanabe, Defendant Nakano, and Mr. Saito remained behind the scenes and had another person step to the forefront of the negotiations.

Operate collective bargaining and monetary claims against companies as a business through weekly numerical management.

Mr. Watanabe creates the strategy, Defendant Nakano builds the brand, Mr. Saito verifies the numbers, and the operational team exerts pressure on the companies.

Their division of labor to stay out of the spotlight is so perfect it makes you want to call them the "Golden Trio."

However, only the internal division of roles looks perfect.

Who were the union members? This is the fundamental issue of the organization.

Why were Defendant Tatsuki Nakano's promotional materials at the Last One Mile office?

With this new information, the use of specific company resources connecting Last One Mile Co., Ltd. and past labor union operations has also come to light.

Free long-term storage of a large volume of promotional materials

Defendant Tamaki Nakano had been frequently visiting the office of Last One Mile Inc. since that time.

And, under the direction of Mr. Makoto Watanabe, a large amount of promotional materials used for labor union activities were reportedly stored inside the office of Last One Mile Co., Ltd., which has no relation whatsoever to the labor union.

Storage fees and facility usage fees were not paid, and a considerable amount of space was occupied for a long period of time.

Office floor space is not free. The company pays for rent, common area maintenance fees, security fees, air conditioning costs, and management fees.

If Mr. Watanabe and his colleagues' private labor union business used the rented space of Last One Mile Inc. free of charge as a warehouse, who received the economic benefit, and how much was the loss borne by the company?

Use the call center headquartered in Fukuoka as a labor consultation service counter

Furthermore, there is information that Mr. Watanabe even operated a labor consultation desk using the call center at the Fukuoka headquarters of Last One Mile Co., Ltd.

Official Business Introduction of Last One Mile Inc.It includes the alliance business, the free internet business for apartment buildings, the contact center business, the hotel business, the listing/media business, and others.

Specific contact center services listed include call centers for government agencies, housing equipment repair reception, secretarial services, sales agency, surveys, and moral complaint resolution.

However, the operation of labor unions, labor consultation reception, collective bargaining support, and unpaid overtime claim services are not listed anywhere.

If Last One Mile Co., Ltd. operated the labor consultation desk as an official commissioned business, records of contracts, estimates, invoices, sales, costs, personal information handling agreements, and board of directors or internal decision-making records must exist.

If no such contract exists, it would mean that Mr. Watanabe was illegally diverting the listed company's call center, personnel, phone lines, systems, and working hours to his own private labor union business without authorization.

If you have a contract, please show it to me.

Please explain why, if there was no contract, company employees were answering the phone for Mr. Watanabe's private business.

Who held the client's personal information?

Labor consultations handle extremely confidential information, such as the consultant's name, employer, salary, overtime hours, reason for dismissal, medical history, harassment victimization, family circumstances, and union membership status.

If Last One Mile Co., Ltd.'s call center was the reception desk, the following information management must also be clarified.

The system and database that recorded the consultation details.

Presence or absence of call recording, retention period, and storage location.

The purpose of using personal information presented to the consultant.

Employees, executives, and external parties who had access to the consultation records.

Labor union, Mr. Watanabe, Defendant Kazuyoshi Nakano, Mr. Satoshi Saito, information sharing route to the perpetrators.

The extent to which the consultant's information was used for negotiations, billing, and sales activities directed at companies.

The money paid by the consultant and its ultimate destination.

If consultation information entrusted to protect workers was diverted for management's sales management or pressure on the company, it is an act that fundamentally destroys the trust in the labor union.

Article 355 of the Companies Act: Directors shall comply with laws and regulations, the articles of incorporation, and resolutions of shareholders meetings, and shall faithfully perform their duties for the stock company.

Using the company's office, personnel, telephone, systems, and working hours for the private benefit of the representative director or their associates is the exact opposite of performing duties "faithfully for the sake of the stock corporation."

If you caused financial damage to the company and conferred benefits upon Mr. Watanabe or a third party, not only does this constitute a breach of the duty of loyalty, but aggravated breach of trust and other criminal liabilities will also be considered.

The three labor rights are not a license for management to collect money.

Labor unions are specially protected by the Constitution because there is a real power imbalance between workers and employers.

A single worker cannot express opinions to an employer on equal footing due to the fear of dismissal, demotion, wage reduction, or reassignment. That is why the right of workers to unite, negotiate collectively, and take action is guaranteed by the Constitution, the supreme law.

<blockquote class="wp-block-quote is-layout-flow designed the whole thing, hosted weekly meetings, gave instructions to the executors, a certified public accountant verified the figures, Defendant Shoki Nakano built the brand, and they used the facilities and call center of a listed company, then this is the exact opposite structure of a worker-led, voluntary organization.

Displaying a labor union sign does not justify any and all pressure.

Article 1, Paragraph 2 of the Labor Union Act: Under no circumstances shall the use of violent negotiations to extort money for the personal gain of the operators.

Collecting unpaid wages and extorting money from a company are completely different things.

It is a legitimate labor union activity for a labor union to demand unpaid overtime for its members, seek the retraction of unfair dismissals and settlement money, and reach an agreement through collective bargaining.

Collecting union dues or having members bear activity expenses is not illegal simply by doing so.

The issue is whether the demands were decided by the workers themselves, or whether Mr. Watanabe and the others determined the target companies, claim amounts, and negotiation methods, using the labor union as a front to serve their own interests.

If intimidation that instills fear in the other company was used, and money was handed over as a result, then apart from labor union activities, the question of whether the crime of extortion has been committed arises.

Article 249, Paragraph 1 of the collective bargaining was conducted in a strong tone does not immediately constitute the crime of extortion.

It is necessary to individually investigate who threatened what kind of harm, what the target company feared, under what pretext the money was paid, to whom it was paid, and who ultimately received that money.

That is precisely why we must make all weekly class="c-blogLink__text">[Last Mile Labor Union] Official Notification Destination for Collective Bargaining

Why did the company ignore the information dissemination and the issues raised regarding internal control by our union, and instead steer the conversation toward collective bargaining, which we had not even requested?

Based on this new information, one explanation comes to mind.

In the labor unions formerly handled by Mr. Watanabe and others, the core of their activities consisted of receiving labor consultations, initiating collective bargaining with companies, demanding money, and managing those figures on a weekly basis.

Based on that experience, wouldn't the Last One Mile management have assumed that labor unions are organizations that invariably demand collective bargaining from companies and seek financial compensation?

There is a possibility that they did not understand constitutionally protected labor union activities, in which workers voluntarily unite to bring internal wrongdoing to light and demand the company reform itself.

If they assumed that other labor unions operate for the same purpose because they themselves have used labor unions as a mechanism for collecting money, and therefore steered the conversation toward collective bargaining and financial claims from the outset, there could hardly be a more revealing self-introduction.

Article 7, Item 3 of the Labor Union Act: The employer shall not control or interfere with the formation or operation of a labor union by workers.

Mr. Watanabe's past control of another labor union does not justify him controlling our current union.

Rather, if they are bringing past domination experiences into the current union and attempting to connect them to the identification of union members, the suspension of activities, and dismissals, this constitutes a circumstance that demonstrates the premeditated nature of the domination and interference.

Did Makoto Watanabe try to resume it as an official last-mile business?

According to information received by our union, after Makoto Watanabe assumed the position of Representative Director at Last One Mile Inc., he planned to leverage the experience he gained from past labor union activities to develop a similar business as an official enterprise of Last One Mile Inc.

Currently, the company's official website does not mention labor union operations or labor consultation services.

However, what is not published and what is not done internally or within affiliated companies are not the same thing.

The board of directors and the audit and supervisory committee should investigate whether the company is secretly engaging in labor consultation services, billing companies, or providing support for collective bargaining under the guise of contact centers, secretarial services, consulting, moral complaint resolution, or other pretexts.

At the very least, if the call center at the Fukuoka headquarters was used in the past and labor union promotional materials were kept in the office, the company cannot simply dismiss it by claiming ignorance or lack of involvement.

If the commercialization has been officially decided, please provide the approval and disclosure.

If company resources were used without a formal decision, please show who authorized the unauthorized use, who bore the costs, and who benefited.

The role titled “Labor Union Task Force,” which was added to Makoto Watanabe’s Secretariat

In the previous article, regarding Makoto Watanabe's secretariat, we outlined the chain of command: the head of the secretariat who manages financial products, a private secretary who supports Watanabe's personal life with company salary, and their spouse who acts as Watanabe's shadow operative.

Based on this new information, that operational unit even had the roles of standing at the forefront of the labor union, negotiating with the company, and even reporting figures at weekly meetings.

Financial instruments, private life, foreign affairs, ties with antisocial forces, and labor unions.

Activities that appear separate on the surface are integrated into a single private action organization through Mr. Watanabe's instructions, personnel surrounding his private secretary, and the funds and equipment of Last One Mile Inc.

The recurring pattern is a structure where Mr. Watanabe stays out of the spotlight, has another person execute the actions, uses the credit and resources of the company or related entities, and funnels only the profits and control to Mr. Watanabe's side.

If they were operating even the labor union under the same structure, this was not a one-time whim.

Management by Makoto Watanabe, characterized by the repeated and continuous use of other people's names and other organizations.

Public them?

What is the reason why, while demanding strict identity verification for other people's labor unions, they did not verify the union members, accounting, finances, and use of company resources regarding the past labor unions operated by Mr. Watanabe and others?

Measures Sought by the Last Mile Labor Union

Last Mile Inc. shall make this matter a formal agenda item for the Board of Directors and the Audit and Supervisory Committee.

Mr. Makoto Watanabe must be completely removed from the process of selecting the investigative firm, accessing evidence, interviewing relevant parties, and approving the investigation results.

Initiate a third-party investigation conducted by independent outside attorneys, certified public accountants, and digital forensics experts.

Preserve all labor union-related emails, chats, phone calls, weekly meeting materials, income and expense statements, project management spreadsheets, contracts, invoices, and bank records from 2019 onward.

Preserve call recordings, shifts, attendance, phone numbers, CRM data, and consultation records of the Fukuoka Head Office Call Center.

Investigate the receipt and shipment of promotional materials stored at Last Mile Office, Inc., as well as their storage periods, production costs, printing costs, and facility usage fees.

Investigate the money received from the corporation by transaction unit regarding the paying company, purpose of payment, amount, deposit account, distribution destination, and ultimate beneficiary.

Conduct an independent information management investigation to determine whether the personal information of labor consultation applicants has been used for unintended purposes or provided to outside parties.

Do not shift the responsibility solely to the individuals put at the forefront of negotiations or call center employees; instead, clarify who gave the instructions, who approved them, and who benefited.

If improper financial claims or personal use of company resources is confirmed, damages must be reimbursed to the affiliated companies and Last One Mile Co., Ltd.

Investigate whether there are any ongoing labor union-related projects, and if they exist, publicize the operating entity, contracts, revenue, and number of users.

Immediately cease all interference with our union, including activities such as suspension of union activities, identification of union members, demands for dismissal, and any other forms of domination and control.

Prohibit the tracking, intimidation, transfer, dismissal, or any other form of adverse treatment of union members, those seeking consultation, informants, and those cooperating with investigations.

Explain the survey results specifically to employees, shareholders, business partners, consultants, and the market.

It is unacceptable to turn workers' rights into sales and then stop the moment it turns toward yourself.

This article does not reject labor unions that conduct rigorous collective bargaining with companies.

If the employer refuses to pay unpaid wages and ignores wrongful termination and harassment, the labor union should negotiate firmly and recover the workers' rights.

However, the entity that exercises that right is the worker.

This is not a system where executives choose target companies from behind the scenes, deploy operatives, certified public accountants verify the numbers, other executives build a brand, and they use the call centers and offices of a listed company to pursue their own sales.

While Makoto Watanabe is alleged to have used labor unions to demand money from companies, he demanded that a labor union voluntarily formed by workers of Last One Mile Inc. suspend its activities, hand over its members, and even take custody of them after dismissal.

Infiltrate spies into other people's labor unions.

I will offer up my own labor union's unrelated last-mile call center and office.

Nothing illustrates Mr. Watanabe's view on labor unions as clearly as this double standard.

For Mr. Watanabe, labor unions were likely not about workers' rights; rather, they were a revenue-generating device when he could control them, and targets for elimination when directed at him.

Turning workers' consultations into weekly figures, and turning harassment and unpaid wages into sales, is not management.

It is the privatization of Article 28 of the Constitution.

If there is one number that should be managed first in the weekly meeting, it is not how much was collected from clients.

This is the number of days the Board of Directors and Audit and Supervisory Committee of Last One Mile Co., Ltd. have continued to run away without investigating or responding since learning of this issue.

At present, the achievement rate of accountability regarding the "labor union business" by Makoto Watanabe and others is zero.

Last Mile Labor Union
